GROWTHIFYE ONE-PAGER·MERC · Maharashtra·tariff order·Case 212 of 2022·Order dated 2023-04-21

MERC issues corrigendum correcting clerical/tabulation errors in BEST's 31-Mar-2023 MTR Order (truing-up FY19-20 to FY21-22, provisional FY22-23, ARR & tariff for FY23-24 & FY24-25)

Corrigendum Order: Petition of Brihanmumbai Electric Supply and Transport Undertaking (BEST) for Truing-up of Aggregate Revenue Requirement (ARR) for FY 2019-20, FY 2020-21 and FY 2021-22, Provisional Truing-up of ARR FY 2022-23 and revised ARR & Tariff for FY 2023-24 and FY 2024-25

Background · what was sought

BEST's MTR Order dated 31 March 2023 (Case 212 of 2022) approved truing-up of ARR for FY19-20 to FY21-22, provisional truing-up for FY22-23, and revised ARR/tariff for FY23-24 and FY24-25. Post-issuance review revealed inadvertent drafting/tabulation errors: wrong para heading clubbing Consumer Security Deposit with Interest on Working Capital, category-name mismatch in the LT tariff impact table (Table 302) due to omission of LT-I(A) BPL row, incorrect linking of Fixed Charges to wrong LT categories in Annexure 1, and omission of certain 'Applicability' clauses for LT-IV(B) Public Services-Others carried from the MYT Order dated 30 March 2020. This corrigendum corrects these errors without altering the substantive tariff decision.

What the Commission decided
  • Deleted Para 6.10.8 (CSD interest rate) and revised Para 6.10.9 to refer only to 'Interest on Working Capital' for Wires and Supply Business, removing the erroneous clubbing with CSD
  • Corrected Table 302 category labels: LT categories were misaligned due to omission of 'LT-I(A) BPL Consumer'; each LT category's ABR/tariff figures re-mapped to the correct category name
  • Corrected Annexure 1 Fixed Charges linkage for FY 2023-24: values for LT2(b), LT3A, LT3B, LT4A, LT5A and LT5B categories were swapped with adjacent categories and have now been correctly assigned
  • Directed that the FY23-24 Fixed Charges correction impact be addressed in true-up during the next tariff determination process, consistent with past practice
  • Restored omitted 'Applicability' clauses (items p-s: public street lighting, public gardens, traffic signals/islands, public water fountains) under LT-IV(B) Public Services-Others to align with the MYT Order dated 30 March 2020
  • No change made to the underlying ARR, revenue gap or overall approved tariff increases for FY23-24/FY24-25
Way forward agreed by the Commission
  1. BEST and MERC office to reissue/read the MTR Order with corrected Paras 6.10.8/6.10.9, Table 302, Annexure 1 and LT-IV(B) applicability clauses
  2. Impact of the Fixed Charges correction for FY23-24 to be reconciled and addressed in the true-up during BEST's next tariff determination (FY25-26 MYT/ARR filing)
  3. Consumers/utilities to align billing systems with corrected category names (esp. LT-I(A) BPL vs LT-I(B) Residential) and corrected Fixed Charges from date of applicability
  4. No fresh public consultation or stakeholder process required since corrections are clarificatory, not substantive
  5. BEST to update consumer-facing tariff schedules/website to reflect corrected Annexure 1 and Table 302
What it means for C&I buyers, OA users & developers
  • • HT-I Industry and HT-II Commercial C&I consumers see confirmed tariff hikes of ~13.6%/5.4% and ~4%/2.9% for FY23-24/FY24-25 respectively — no change from original MTR intent, only labeling fixed
  • • LT-III(b) Industrial and LT-II commercial (20-50kW, >50kW) consumers should verify their correct Fixed Charge slab (₹/kVA or ₹/month) as several were swapped in the original order
  • • No new open-access, RE or storage tariff changes are introduced by this corrigendum — it is purely a corrections notice to the March MTR Order
  • • C&I developers relying on BEST's tariff schedule for cost modelling should use the corrected Table 302/Annexure 1 figures, not the original 31-March version
Growthifye take

This is a housekeeping corrigendum, not a fresh tariff decision — the approved ARR and headline tariff increases for BEST's C&I categories (HT-I ~13.6%/5.4%, HT-II ~4%/2.9%) stand unchanged. The only actionable item for C&I buyers is to cross-check billing against the corrected category names and Fixed Charges in Annexure 1, since several LT categories had swapped figures. No commercial strategy shift is warranted beyond a billing-accuracy check.

Values are compiled from tariff orders published on the websites of State Electricity Regulatory Commissions and distribution licensees (plus CEA / MoP / Grid-India), parsed automatically and shown with their source. Always verify against the signed order before any commercial decision. This one-pager is a Vidura-assisted summary of the official order; the signed order prevails.
