MERC issues corrigendum correcting 8 drafting errors in TPC-D's MYT Order dated 30 March 2020 (Case 326 of 2019)
Case of The Tata Power Company Ltd. (Distribution) for approval of True-up of Aggregate Revenue Requirement (ARR)for FY 2017-18 and FY 2018-19, Provisional Truing-up of ARR for FY 2019-20, and approval of ARR and Tariff for the Multi-Year Tariff (MYT) 4thControl Period from FY 2020-21 to FY 2024-25
MERC had passed a Multi-Year Tariff Order dated 30 March 2020 in Case No. 326 of 2019 approving TPC-D's ARR true-up for FY2017-18 and FY2018-19, provisional true-up for FY2019-20, and ARR/Tariff for the 4th MYT Control Period FY2020-21 to FY2024-25. This corrigendum, dated 25 April 2020, corrects clerical/drafting errors identified in that Order relating to consumer category applicability clauses, a fixed-charge note, and an incorrect entity reference.
- Corrected LT I(B) Residential category note: HV supply applicability now covers purposes (a) to (h) and (k)&(l), not (a) to (k)
- Amended LT III Industrial point (g): Sewage/Common Effluent Treatment Plants reclassified as excluded from 'LT – Public Services' category (was 'LT – Public Water Works')
- Amended HT I Industrial point (g): same STP/CETP exclusion changed from 'HT – PWW' to 'HT – Public Services' category
- Deleted Point (l) 'Waste processing units not covered under LT IV category' from LT IV(B) Public Service Others applicability
- Removed 'Laundries' from applicability list of LT II Non-Residential/Commercial (point f) and HT II Commercial (point f)
- Deleted Note 3 (Rs.250/10kW additional fixed charge above 10kW) from Tariff Table notes in Sections 6.10–6.14; corrected entity name from 'MBPPL' to 'TPC-D' in Section 6.7.16 PF display direction
- TPC-D to apply revised category applicability clauses (LT I(B), LT III, HT I, LT II, HT II, LT IV(B)) with immediate effect from corrigendum date
- TPC-D to remove the deleted Rs.250/10kW additional fixed charge note from billing under Sections 6.10-6.14 tariff tables
- TPC-D (not MBPPL) to continue displaying PF (leading and lagging RkVAh) in consumer bills across all categories till further directions
- Consumers and TPC-D billing systems to be updated to reflect corrected category definitions (STP/CETP under Public Services, not PWW)
- No further compliance timeline specified beyond immediate incorporation into the MYT Order
- • Sewage/Effluent Treatment Plant consumers (industrial/commercial) should verify billing category is now 'Public Services' not 'Public Water Works', which may affect applicable tariff
- • Laundries no longer fall under LT II/HT II Commercial category per this correction — affected consumers should check correct tariff classification
- • Removal of the Rs.250/10kW additional fixed charge (above 10kW) reduces fixed charge burden for consumers previously subject to this note under Sections 6.10-6.14
- • High-Voltage consumers under LT I(B) Residential should re-check applicability scope now limited to purposes (a)-(h) plus (k)&(l)
This is a housekeeping corrigendum, not a tariff or policy change—no ARR, tariff rate, or MW/MWh figures are altered. C&I consumers, especially STPs/CETPs, laundries, and those near 10kW load thresholds, should re-verify their billing category and fixed charges against these corrected clauses to avoid misclassification or overbilling under the 4th MYT Control Period (FY2020-21 to FY2024-25).
